Scheduling an Appointment

Potential Customers should book pre-purchase appointment(s) through the app at www.innonlakechamplain.com which allows for riding sessions as well as rooms at our Inn (with riding as an add-on) to be easily booked with cc payment. You may use the farm tour add-on if you are coming to look at foals, weanlings, or other non-riding horses. Please do not schedule pre-purchase riding appointments on Fridays or Sundays, May-October.
Your pre-paid appointment serves as a deposit to hold up to two specified horses until the appointment date, please do not schedule a pre-purchase appointment more than seven days prior to your desired appointment (because your appointment fee serves as a holding deposit). LSF website is kept up to date re: horses available, please check the website before you drive if you are unsure which horses you would like to see/try.
Your paid appointment provides for up to three hours total riding time (which can be used for up to two riders, 1-3 horses, or three consecutive days).

Pre-Purchase Appointments

Your LSF pre-purchase appointment expenses will be deducted from your total purchase price (up to two room-nights and two riding packages may be credited, if they were used), should you decide to purchase.
Your pre-purchase fees will be fully refunded if your appointment is cancelled due to unforeseen circumstances on our farm (such as preferred horse is not available to try due to sale, unsoundness, death, or injury).
Breeches, boots, helmets, and release of liability are required for riding. You may use your own saddle if the tree is a suitable fit.
Appointments follow a riding lesson format, horses will not be overworked, horses will not be tested beyond their current training abilities as demonstrated by sales video(s) or as rider(s) will be directed in-person. Horses designated ‘Green’ can be test ridden only by USEF, etc. trainers and their students.

First Come-First Served, Show Homes, Etc.

Generally horses are held on deposit only. However, repeat customers, experienced pro and AO buyers, show homes, and buyers coming with references and/or USEF trainers receive preferential treatment, leeway may be granted for repeat customers and certain other offers.

Non-Refundable Deposit

Horses are held for 14 days with 10% non-refundable deposit and/or 12 months with 10% deposit and satisfied payment and board contracts. Potential buyers pursuing purchase without an appointment can request one (1) current jog video to be sent <24 hours prior to anticipated deposit. Deposits/payments/veterinary costs/fees/etc. paid to LSF and/or Lani Ohly are not refunded for any reason, even unfavorable veterinary findings.

Pre-Purchase Veterinary Exam Policies

Potential buyers may pursue PPE after pre-purchase riding session(s) or sight-unseen by paying a 10% deposit. Please be aware that horses and foals often sell, sight unseen, on photos and videos alone. Your paid riding appointment alone does not hold a horse against more confident buyers, willing to move their purchase forward with a deposit.
Horses are held a maximum of 14 days from 10% deposit for veterinary work and buyer decision.
Third party deposits are not accepted until the vetting party has rejected the horse (automatic at 14 days from deposit without executed purchase agreement).
All PPE takes place within 7 days of 10% deposit. Horses do not leave the farm prior to full payment, for any reason, unless transported and attended by a representative of LSF.
Local veterinarians are available for basic workup, x-rays require travel to Saratoga or elsewhere. Potential buyers should expect to have basic work and any x-rays locally, with conversation directly with the vet about the work-up desired. Diagnostic evidence can be forwarded to potential buyers’ veterinarian of choice, as arranged with the local veterinarian by potential buyer. Potential buyer is responsible to pay the veterinarian directly.
Veterinary prep/travel/fuel/insurance/attendance fee ($280) is paid prior to scheduling the veterinary appointment, plus $35/additional hour for any workup greater than eight hours total roundtrip.

Payment Methods

Credit card payment for pre-purchase appointments followed by veterinary travel is accepted through our guest accommodation app at www.innonlakechamplain.com. Veterinary travel expenses are charged prior to veterinary travel, with final adjustments following the appointment. Invoices can be sent via PayPal, apple pay, or Venmo by request.

Insurance, Risk of Injury, Incident, and/or Loss

Buyer is responsible to start/maintain insurance for their purchase upon signing a purchase agreement, including Payment Plan. The buyer, agrees to take on all responsibility for injury or death to the horse, injuries caused by it, and prevention thereof upon signing a purchase agreement.
Signed purchase contract follows opportunity to examine and will contain any/all pertinent disclosures. Injury or lameness arising subsequent to transfer are buyer's responsibility, liability, concern, etc. Buyer is advised to obtain insurance that covers emergency veterinary expenses, loss of use and/or unsoundness, and death.

Acknowledgements, Disclosures, and Warranties

As a breeding and rehabilitation business we thoroughly evaluate each prospect for potential soundness issues, riding each horse in real workouts for 30-60 days before pricing/listing/posting videos to ensure that each horse has the physical and mental soundness to be sold. We have a strong commitment to 1. R&R recovery time for past injuries, 2. Slow progress in training, 3. Listening to the horse for signs of pain and 4. Adding more layoff time as needed. However, new soundness issues can arise at any time.
We take the time to correct any known mistaken beliefs held by the buyer regarding the horse's condition, fitness, or soundness and take all due time to fully disclose all known, relevant facts with regard to condition, fitness, and suitability of the horse for the buyer’s specified purpose.
PPE is useful for finding/evaluating past injuries and other issues that may become apparent with changes in training, management, or age. All horses are purchased with full disclosure of all known or suspected conditions, and any dissatisfaction to be resolved according to our refund policy below.
Your signed purchase agreement Acknowledgements, Disclosures, and Warranties section will read as follows:
Buyer is offered opportunity to conduct examinations by trainer(s), veterinarian(s), and/or other trusted equine professionals prior to purchase and/or transfer of physical possession, horse assumed sound and healthy by all parties upon transfer.
The buyer acknowledges that the horse is purchased as-is, 'xyz basic description of horse and past history'. Any previous oral statements or claims by the seller, if not included in the written contract, are not binding, 'xyz advertising and other materials attached as appendices'.
Seller acknowledges that any known mistaken beliefs held by the buyer regarding the horse's condition, fitness, or soundness must be corrected and that intentionally lying to or misleading the buyer is illegal. Seller acknowledges that all known, relevant facts have been disclosed regarding the condition, fitness, and suitability of the horse for the buyer’s specified purpose 'xyz purpose'.
Seller hereby guarantees that with 'xyz basic care/goals', there are no known conditions that would hamper the horse’s performance in this capacity.

Post-Purchase Shipping Available

$25/mile (round-trip), within the Northeast.
Horses do not leave Lakeside Farm until paid in-full, except on deposit paid, cash upon delivery arrangements. Horses crossing state lines will require all relevant veterinary papers, at buyer’s expense (arrangements are often made for sharing the cost of veterinary farm visit for paperwork and health examination).
Please plan to have your horse shipped within ten days of signing, except horses on payment plan which are shipped within ten days from final payment unless a training and board contract has been signed.

Refund Policy

Finding a new home and a new family is very stressful for horses; as such, we expect our buyers to be quite sure before beginning the purchase process.
If you are dissatisfied with your purchase for any reason, horses are welcomed back and up to 80% of purchase price is refunded at the rate of -10% per day from day three away, calculated from date of transfer of physical possession to date of restored physical possession in same or better physical condition to Lakeside Farm. ie. <4 days trial = 80% refunded, <5 days = 70% refunded, <6 days = 60% refunded, <7 days = 50% refunded, <8 days = 40% refunded, <9 days = 30% refunded, <10 days = 20% refunded. Horses are expected to be returned indisputably unharmed (some weight loss is accepted). All horses will have a training session recorded upon any return, for soundness and training comparison with pre-sale recording(s).
Buyer is responsible for return shipping arrangements and expenses.
Buyer agrees to take all necessary precautions to ensure that the horse is returned to the seller unharmed (in the event of return); including but not limited to handling the horse with appropriate equipment, appropriate turnout time and facilities (as similar as possible to seller’s care arrangements), limiting close contact with other horses, being mindful of footing conditions, etc.
The buyer shall limit training activity, not test or exceed current fitness and training level, and will refrain from reckless activities such as testing over unfamiliar jumps (jumping shoot or otherwise), breaking un-started horse(s) for riding, etc. until the end of the ten day refund period.
If buyer is unable to return horse to seller (in the event of return) in sound condition buyer shall seek remedy with buyer's insurance carrier.
Buyer will refrain from altering all registry paperwork until day 11; there is no refund for paperwork altered, missing, or returned in condition unsuitable for other buyers.
There is no refund for horses injured, harmed, killed, lost, or returned in condition unsuitable for other buyers.
There is no refund for horses purchased on payments.

Lifetime Policy

Our horses and ponies are welcomed home without regard for condition or soundness (via relinquishment, shipping at buyer’s expense). Where appropriate, horses and ponies may be rehabilitated, retrained, and resold (with all pertinent disclosures), used in our breeding or riding programs, retired, or euthanized.
Buyer agrees that Lakeside Farm horses are not to be sold via traditional public live auction.

Binding Agreement

A copy of these terms will be sent via email to all potential buyers upon scheduling pre-purchase appointment(s). Please be sure to read your email version for changes (as cookies may be storing an older version of this contract on your device) and disclosure(s) specific to the horse(s) you are evaluating. Purchase Contract/Bill of Sale/Registry Paperwork execution(s) take place concurrent with physical and legal transfer, upon final payment (except payment plan contracts which are signed 12 months prior to final paperwork). Potential buyer agrees to all published terms prior to scheduling pre-purchase appointment(s).

Payment Plan(s), Training & Care

Horses purchased on a payment plan pay 8.25% of purchase price for 11 monthly payments plus $200/month board (from purchase, but not prior to weaning at ~six months of age), monthly for 11 months, following 10% deposit.
Horses staying for two full years from weaning pay 10% on signing and 3.8% of purchase price for 24 months from 6 months of age (plus $200/month board).
Horses purchased on a payment plan have routine handling and care. Veterinary, de-worming, hoof care, etc. will be added to monthly invoices with written approval for the recommended care (hoof trimming $40, deworming $20). We recommend adding and/or maintaining training while your horse is in our care (lesson/training packages described at https://www.lakesidefarmny.com/horsebackriding.html).
Payment plan accommodations and coaching are available, please book your visits and training sessions through The Inn on Lake Champlain. Training sessions are video-recorded, but are not a contractual obligation due to potential for videography/tech malfunctions.
We reserve the right to decline shipping services (including loading assistance) to payment plan colts that have not had at least four sessions on trailering leading up to anticipated departure.

Breach of Contract

A buyer is considered delinquent if their contract is $4,000 overdue and/or contract is unsatisfied by three months past the specified term of the contract, including board for all months and any additional (pre-approved/contracted) care or training expenses.
Horses with delinquent or incomplete purchase contracts will not be physically or legally transferred to the buyer and may be offered to third parties. No amount is returned to delinquent buyers.
Any attempt to remove horses from Lakeside Farm prior to payment in-full of all purchase, board, training, and care invoices will be pursued in criminal and civil court.
Buyer pays all legal fees in the event of a dispute, including service for non-communication, certified postage, printing costs, court costs, reasonable time spent, and legal fees.

Governing Law

All purchase and pre-purchase terms are governed by the laws of the State of New York. Parties agree to participate in mediation prior to court appearance (where available). Mediation and legal action, should they be necessary are to occur in Washington County, NY.
